The Oncologic Athlete – Terms of Service


1. Introduction

Welcome to The Oncologic Athlete (TOA). Our services are designed to support cancer survivors and individuals in treatment as they pursue strength, resilience, and long-term health. Services may include exercise prescription, physical therapy, wellness coaching, and advanced performance assessments. By engaging in our services, website, or social media platforms, you agree to the terms outlined below.

2. Scope of Services

The Oncologic Athlete provides survivorship-focused services built on exercise science and physical therapy, including:

  • Exercise and Wellness Programming: Aerobic training, strength training, and mobility exercise tailored to cancer survivors’ needs.

  • Physical Therapy Services: Licensed physical therapists may provide treatment for pain, weakness, movement limitations, or other health concerns within their scope of practice.

  • Wellness & Performance Assessments: Services may include VO₂ Max testing, resting metabolic rate testing, and DEXA scans (in partnership with Boston Direct Health).

  • Nutrition & Lifestyle Guidance: Delivered by physical therapists, focusing on survivorship health, recovery, and prevention.

3. Qualifications of Providers

Our team includes licensed doctors of physical therapy, exercise physiologists, dietitians, and survivorship specialists. Depending on client needs, services may be provided in the capacity of physical therapy, wellness coaching, or performance consulting. Physical therapy is provided under state licensing laws; other services are considered wellness or educational support.

4. Limitations and Disclaimers

  • Not Medical Oncology Care: Exercise, nutrition, or performance guidance provided outside the scope of licensed physical therapy does not replace oncology treatment, medical diagnosis, or clinical advice.

  • Non-Covered Services: Most survivorship wellness services—including exercise programming, DEXA scans, and lifestyle reviews—are not covered by insurance and are the client’s financial responsibility.

  • All Physical Therapy sessions are out-of-network, and the client is responsible for paying an agreed upon rate to The Oncologic Athlete. Clients will have the opportunity, based on medical necessity to file for reimbursement with their healthcare provider. This reimbursement is the responsibility of the client, and not The Oncologic Athlete.

  • Facility Indemnification: For sessions conducted at partner facilities, and other facilities, clients agree to indemnify and hold harmless the facility, its owners, and affiliates from any claims, damages, or expenses related to participation.

5. Privacy and HIPAA Compliance

When physical therapy or diagnostic services are delivered, TOA complies with HIPAA standards to protect your health information. For wellness services outside physical therapy, strict internal privacy practices are followed to safeguard client information.

6. Filming and Media Release

TOA may occasionally film or photograph sessions for education and community awareness. By engaging in TOA services, you agree to the possibility of being filmed or photographed and grant permission for use in marketing, education, or social media, unless you opt out in writing. No personal or identifying details will be shared without your consent.

7. Client Responsibilities

Clients should:

  • Disclose any health conditions, treatment history, or limitations.

  • Participate only in activities they are physically able to perform.

  • Seek medical clearance or guidance from their oncologist or physician as appropriate.

8. Liability Waiver

By participating in TOA programs—including physical therapy, exercise training, or assessments—you acknowledge and accept all risks associated with exercise and wellness activities. The Oncologic Athlete and its providers are not responsible for injuries, health issues, or adverse outcomes arising from participation.

9. Governing Law

These Terms and Services are governed by the laws of Massachusetts. Any disputes shall be resolved within the jurisdiction of Massachusetts.

10. Cancellation Policy

  • First Cancellation: Clients may cancel their first session without penalty.

  • Subsequent Cancellations:

  • Cancellations made more than 48 hours in advance will not be charged.

  • Cancellations made within 48 hours of the scheduled session will be charged in full.

11. Package Purchases

  • Grace Period: Clients are welcome for a full refund up to 6 weeks when purchasing a package.

  • Refunds: No refunds will be given after 6 weeks

12. Refunds and Transfers

  • Refunds for unused sessions or packages are not provided unless explicitly stated in writing at the time of purchase.

  • Sessions are non-transferable and may only be used by the original purchaser.

13. Code of Conduct

  • Clients are expected to arrive on time and respect staff, fellow clients, and facilities.

  • The Oncologic Athlete reserves the right to discontinue services if client behavior violates community standards or disrupts care.

14. Insurance Disclaimer

While TOA may assist in providing general information on insurance or coverage, this is not a guarantee of payment. You are fully responsible for verifying your insurance details, including co-pays, deductibles, and authorizations. Clients are financially responsible for all balances not covered by insurance.

15. Changes to Terms

The Oncologic Athlete reserves the right to update these terms at any time. Notice of significant changes will be provided, and continued use of services indicates acceptance of revised terms.
